According to NBC NewsChannel 13, Trey Anastasio was sanctioned by New York state drug court last week and ordered to spend two days in a Washington County Jail. Anastasio has been living in Saratoga Springs, NY since the winter of 2007 after he admitted to driving while under the influence of drugs in Whitehall, NY in December 2006 and was sentenced to participation in Washington County's drug court program. At the time of his arrest, Anastasio had Vicodin, Percocet, Xanax and heroin in his car.

While the exact reason for his recent sanction is still unknown, it is believed that Anastasio either failed to show up for his drug rehabilitation program or failed a court-ordered drug test. Anastasio has since been released from jail. The former Phish guitarist has remained largely under the radar since entering drug court, though he did emerge to perform with both Dave Matthews Band and Phil Lesh & Friends when both acts performed in or around Saratoga Springs.
